Terms of service

These Terms of Service ("Terms") govern your use of FolderGluerParts.com (the "Site") and purchases from Folder Gluer Parts ("we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site or place an order.
1. Eligibility and account responsibility
You must have legal capacity to enter into a binding agreement. If you purchase on behalf of a business, you represent that you are authorized to bind that business. You are responsible for the accuracy of information submitted through the Site and for activity under your account.
2. Industrial parts, identification, and compatibility
Our products are industrial machine parts and components. Product titles, descriptions, photographs, measurements, cross-references, and recommendations are provided to help identify products, but variations can occur. Before ordering or installing a part, you are responsible for confirming the part number, dimensions, specifications, machine model, application, operating conditions, and compatibility.
Any assistance we provide with part identification is based on the information you give us and does not replace inspection by a qualified technician. Installation, operation, maintenance, and use must be performed by qualified personnel in accordance with applicable safety requirements and the machine manufacturer's instructions. We are not responsible for damage or injury caused by incorrect identification, installation, modification, misuse, inadequate maintenance, or operation outside stated specifications, except to the extent liability cannot lawfully be excluded.
3. OEM, aftermarket, and trademarks
A product is OEM, genuine, or manufacturer-authorized only when the product listing expressly says so. Other products may be aftermarket or replacement components. References to manufacturers, machine models, part numbers, and trademarks are for identification and compatibility purposes. All third-party trademarks belong to their respective owners. No affiliation, sponsorship, or endorsement is implied unless expressly stated.
4. Product information and availability
We try to keep product information, pricing, images, availability, and specifications accurate, but errors and changes can occur. We may correct errors, update information, limit quantities, or cancel an affected order before shipment. If we cancel a paid order, we will refund the amount charged for the canceled item.
Products may be in stock, special-order, made to order, backordered, discontinued, or subject to supplier allocation. Placing an order does not guarantee availability.
5. Orders and acceptance
Your order is an offer to purchase. An automated order confirmation only acknowledges receipt and does not by itself constitute acceptance. We may accept an order by confirming acceptance, beginning fulfillment, or shipping the product. We may refuse or cancel an order for legitimate reasons, including unavailability, pricing or description errors, suspected fraud, payment issues, export restrictions, or quantities inconsistent with normal use or resale arrangements. Any conflicting or additional terms in a purchase order or other customer document are rejected unless we expressly agree to them in writing.
6. Prices, payment, and taxes
Prices are shown in the currency displayed on the Site and may change without notice. The price applicable to an accepted order is the price confirmed for that order, subject to correction of obvious errors before shipment. You authorize us and our payment providers to charge all amounts shown at checkout, including shipping and applicable taxes. You are responsible for taxes, duties, fees, and charges not collected at checkout when applicable.
7. Shipping and delivery
Our Shipping Policy is incorporated into these Terms. Processing and delivery dates are estimates unless we expressly state that a date is guaranteed. Delivery can be affected by inventory, suppliers, carriers, weather, customs, and other events outside our reasonable control. Your rights regarding delayed or canceled shipments remain subject to applicable law.
8. Returns, cancellations, and refunds
Contact us before returning any product. Do not send a return without authorization and return instructions. Return eligibility, time limits, condition requirements, restocking charges, return freight, exclusions for special-order or custom items, and refund timing are governed by any return terms displayed at the time of purchase, any written quote or agreement applicable to the order, and applicable law. Nothing in these Terms limits rights or remedies that cannot lawfully be waived.
9. Warranties and disclaimers
We do not create a warranty merely by providing product information, compatibility assistance, or technical support. Any written warranty expressly offered by us or by a manufacturer is governed by its stated terms and will be made available as required by law. To the fullest extent permitted by law, we disclaim warranties not expressly provided in writing by us, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not permit certain warranty exclusions, so these exclusions apply only to the extent permitted. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost production, downtime, loss of use, or loss of data, arising from the Site, an order, or a product. To the fullest extent permitted by law, our aggregate liability relating to a product or order will not exceed the amount you paid us for the product or order giving rise to the claim.
These limitations do not apply to liability that cannot lawfully be limited or excluded, including liability arising from fraud, willful misconduct, or other matters for which applicable law prohibits a limitation.
11. Customer indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold us harmless from third-party claims, losses, and reasonable costs arising from your unlawful use of the Site, resale representations you make without our authorization, or your improper installation, modification, misuse, or unsafe operation of a product. This obligation does not apply to the extent a claim results from our negligence, willful misconduct, or breach of these Terms.
12. Intellectual property and permitted use
The Site and its original content, design, graphics, logos, and software are owned by or licensed to us and are protected by applicable intellectual-property laws. You may use the Site only for lawful personal or business purchasing and informational purposes. You may not copy, scrape, reverse engineer, interfere with, or exploit the Site except as permitted by law or with our written permission.
13. Prohibited conduct
You may not use the Site to violate law, infringe rights, transmit malicious code, attempt unauthorized access, interfere with Site operation, submit false information, commit fraud, or evade purchase or export restrictions. We may suspend access or cancel affected orders when reasonably necessary to protect the Site, our business, customers, or third parties.
14. Third-party services and links
The Site may use or link to third-party services such as payment processors, carriers, financing providers, and external websites. Their services and terms are controlled by those third parties. We are not responsible for third-party services except to the extent required by law.
15. Events beyond reasonable control
We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, fire, labor disputes, transportation disruption, carrier delay, supplier failure, shortage, governmental action, war, terrorism, epidemic, cyberattack, utility failure, or similar events. This section does not excuse obligations that applicable law does not permit us to delay or avoid.
16. Changes, severability, and waiver
We may update these Terms prospectively by posting a revised version and effective date. Changes do not retroactively alter an accepted order unless required by law or agreed in writing. If any provision is unenforceable, the remaining provisions remain in effect to the fullest extent permitted. A failure to enforce a provision is not a waiver.
